Privacy notice

This notice explains what personal information Nixstar Solutions collects, why it is collected and what happens to it. It is written to meet the Protection of Personal Information Act, 2013 (POPIA).

Nixstar Solutions is a small consultancy run by Nicole Joubert. There is no marketing department and no data broker in the background. In practice this notice describes a short list of ordinary things.

Who is responsible

Nixstar Solutions is the responsible party for the information described here. Nicole Joubert acts as Information Officer and can be reached at nicole@nixstarsolution.com or on +27 73 185 1649.

What is collected

What you send. If you email, message on WhatsApp or send a brief through the contact page, that includes your name, email address and whatever you choose to write.
Client project information. During an engagement, the business information needed to do the work, which can include access to systems, documents and data belonging to your organisation.
Basic technical information. Standard web server logs such as IP address, browser type and pages requested, kept by the hosting provider for security and reliability.

What is not collected

No advertising or tracking cookies are set by this site.
No analytics profile is built about you across other websites.
Nothing is sold, rented or traded to third parties. Ever.

Why it is collected

To reply to your enquiry and discuss whether the work is a fit.
To deliver a project you have engaged Nixstar Solutions to do.
To meet legal and accounting obligations, such as keeping invoices.
To keep the site secure and working.

The lawful bases are your consent when you make contact, the performance of a contract once you become a client, and legal obligation for record keeping.

Who it is shared with

Client work is delivered with a vetted network of developers and quality assurance specialists, some of whom are outside South Africa. They receive only what a specific piece of work requires, and are bound to confidentiality.

Ordinary service providers are also involved, for example email and website hosting. Where information is processed outside South Africa, it goes to countries or providers that offer comparable protection, as POPIA requires.

How long it is kept

Enquiries that do not become projects: up to 12 months, then deleted.
Client records: for the length of the engagement, plus the period required by South African tax and company law.
Server logs: the retention period set by the hosting provider, typically short.

How it is protected

The site is served over HTTPS. Access to email and project systems is protected by strong authentication. Access is limited to people who need it for the work in front of them. No system is perfect, and if a breach affecting your information ever occurs, you and the Information Regulator will be notified as POPIA requires.

Your rights

Under POPIA you may:

Ask what personal information is held about you.
Ask for it to be corrected, completed or deleted.
Object to how it is being used.
Withdraw consent at any time, which does not affect anything done before you withdrew it.
Complain to the Information Regulator of South Africa.

To exercise any of these, email nicole@nixstarsolution.com. You will get a reply within a reasonable period and there is no charge for asking. If you are not satisfied with the response, you may take it to the Information Regulator of South Africa, whose current contact details are published on the Regulator's own website.

Third party content

This site loads fonts from Google Fonts, which means your browser makes a request to Google's servers to fetch them. Links to client projects lead to sites that Nixstar Solutions does not control, and those sites have their own privacy practices.

Changes

If this notice changes, the date at the top changes with it. Material changes will be made obvious rather than slipped in quietly.
